Administrative-legal structure organising
Many organisational issues in the public and semi-public sectors have a legal aspect. Berenschot can handle the setup and change of legal forms. Changes and setups in which administrative issues, like control and management, play an important role. Often, the change or setup of a legal form is prompted by an increase or decrease in scale, a merger or a privatisation. The more at stake, the more important the legal side is. It concerns questions like:
- What are the authority relationships officially, and what will they look like after the change?
- How much binding or distance does there need to remain or be between the parent organisation/administration and the new organisation/management?
- How should the roles of owner and commissioning authority be distinguished? And how do we do that?
- What official procedures must be followed in the event of a change, and which go into effect in the event of a worst-case scenario?
- What are the participants' obligations in the case of a joint arrangement?
- What is and is not allowed under the new regulations and legislations?
